Welcome to Dylimu. These Terms of Service ("Terms") govern your access to and use of the Dylimu website, products, and services. Dylimu produces hardware wallets designed for safe offline cryptocurrency storage. No additional services such as exchanges, custodial storage, or staking are offered.

By accessing or using our website, purchasing our products, or using our services, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our website or services.

Please read these Terms carefully, along with our Privacy Policy and Cookie Policy, which are incorporated by reference into these Terms.

3.1 Hardware Wallets

Dylimu offers hardware wallets designed for the secure offline storage of cryptocurrency private keys. Our products are physical devices that help users securely manage their cryptocurrency assets.

3.2 Product Information

We make every effort to display our products and their features as accurately as possible. However, the colors, dimensions, and details you see on your computer or mobile device screen may vary depending on your monitor, settings, and other factors.

We reserve the right to limit the quantity of items purchased per person, per household, or per order. We also reserve the right to discontinue any product at any time.

3.3 Firmware and Software

Our hardware wallets operate using firmware and may be used with companion software. We provide firmware updates to improve functionality, add features, and address security concerns. By using our products, you agree to keep your firmware updated to maintain security.

Our firmware and software are provided under separate license terms that will be presented to you when you use them. Those license terms are incorporated by reference into these Terms.

3.4 No Custodial Services

Dylimu does not provide custodial services, cryptocurrency exchanges, or staking services. We do not hold, control, or have access to your cryptocurrency assets or private keys at any time. You are solely responsible for managing and securing your private keys and recovery phrases.

4. Purchases and Payment

4.1 Ordering

When you place an order through our website, you are making an offer to purchase products. We reserve the right to accept or decline your order for any reason, including but not limited to product availability, errors in product or pricing information, or problems identified by our fraud detection systems.

After you place an order, you will receive an email confirmation acknowledging that we have received your order. This email does not constitute acceptance of your order; it only confirms that we have received it.

4.2 Pricing and Payment

All prices are shown in US dollars and do not include taxes, shipping, or handling fees, which will be added to your total purchase price. We reserve the right to change prices at any time without notice.

Payment is collected upon delivery of the product. We accept major credit cards, debit cards, and cash payment methods. By providing payment information, you represent and warrant that you are authorized to use the designated payment method.

4.3 Shipping and Delivery

We ship to the address you provide during the checkout process. You are responsible for ensuring the accuracy of your shipping information. We are not responsible for orders that are delayed or delivered to incorrect addresses due to inaccurate information provided by you.

Delivery times are estimates and are not guaranteed. Factors outside our control, such as customs processing for international shipments, may cause delays for which we are not responsible.

4.4 Returns and Refunds

Due to the security-sensitive nature of our products, we have a limited return policy. We accept returns of unopened products in their original, sealed packaging within 30 days of delivery. Products with broken tamper-evident seals cannot be returned.

Defective products are covered under our warranty program. Please contact our support team if you receive a defective product.

Refunds will be issued to the original payment method used for the purchase.

5. Warranties and Disclaimers

5.1 Limited Product Warranty

Dylimu hardware wallets come with a limited warranty against defects in materials and workmanship under normal use. The warranty period varies by product model and is specified in the product documentation. This limited warranty does not cover damage resulting from accident, misuse, abuse, neglect, improper handling or storage, or unauthorized modifications.

To make a warranty claim, please contact our customer support with proof of purchase and a description of the defect.

5.2 Disclaimer of Warranties

EXCEPT FOR THE EXPRESS WARRANTIES SET FORTH ABOVE, Dylimu PROVIDES THE WEBSITE, PRODUCTS, AND SERVICES "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

Dylimu DOES NOT WARRANT THAT THE WEBSITE, PRODUCTS, OR SERVICES WILL MEET YOUR REQUIREMENTS OR THAT THE OPERATION OF THE WEBSITE, PRODUCTS, OR SERVICES WILL BE UNINTERRUPTED OR ERROR-FREE. Dylimu IS NOT RESPONSIBLE FOR ANY PROBLEMS OR TECHNICAL MALFUNCTION OF ANY TELEPHONE NETWORK OR LINES, COMPUTER ONLINE SYSTEMS, SERVERS, PROVIDERS, COMPUTER EQUIPMENT, SOFTWARE, OR FAILURE DUE TO TECHNICAL PROBLEMS OR TRAFFIC CONGESTION ON THE INTERNET OR ON THE WEBSITE OR COMBINATION THEREOF.

SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF CERTAIN WARRANTIES, SO SOME OF THE ABOVE EXCLUSIONS MAY NOT APPLY TO YOU.

5.3 Cryptocurrency Risks

Cryptocurrency investments involve significant risk. The value of cryptocurrencies can fluctuate dramatically, and you may lose all or a substantial portion of your investment. Dylimu is not responsible for any losses you may incur as a result of cryptocurrency market fluctuations, transaction errors, or any other aspects of cryptocurrency management.

You are solely responsible for understanding the risks associated with cryptocurrencies and for making informed decisions about your cryptocurrency assets.

6. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL Dylimu, ITS AFFILIATES, DIRECTORS, EMPLOYEES, AGENTS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, INCLUDING WITHOUT LIMITATION DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO YOUR USE OF, OR INABILITY TO USE, THE WEBSITE, PRODUCTS, OR SERVICES.

WITHOUT LIMITING THE FOREGOING, Dylimu'S TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATING TO THESE TERMS OR YOUR USE OF THE WEBSITE, PRODUCTS, OR SERVICES SHALL NOT EXCEED THE AMOUNT PAID BY YOU TO Dylimu FOR THE PRODUCT OR SERVICE GIVING RISE TO THE CLAIM.

THESE LIMITATIONS WILL APPLY EVEN IF Dylimu HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES AND NOTWITHSTANDING ANY FAILURE OF ESSENTIAL PURPOSE OF ANY LIMITED REMEDY.

SOME JURISDICTIONS DO NOT ALLOW THE LIMITATION OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.

7. Intellectual Property

7.1 Ownership

The website, products, and services, including but not limited to text, graphics, logos, icons, images, audio clips, digital downloads, data compilations, and software, are owned by Dylimu or its licensors and are protected by United States and international copyright, trademark, patent, and other intellectual property laws.

7.2 Limited License

Dylimu grants you a limited, non-exclusive, non-transferable, and revocable license to access and use the website, products, and services for their intended purposes in accordance with these Terms. This license does not include:

  • Modifying or copying the materials
  • Using the materials for any commercial purpose or for any public display
  • Attempting to decompile or reverse engineer any software contained on the website or in the products
  • Removing any copyright or other proprietary notations from the materials
  • Transferring the materials to another person or "mirroring" the materials on any other server

Dylimu, the Dylimu logo, and other Dylimu marks, graphics, logos, and domain names are trademarks or registered trademarks of Dylimu. Your use of the website, products, or services does not grant you any right or license to reproduce or otherwise use any Dylimu or third-party trademarks.

8. User Conduct

By using our website, products, or services, you agree not to:

  • Use the website, products, or services for the purpose of exploiting, harming, or attempting to exploit or harm minors in any way

Any legal suit, action, or proceeding arising out of, or related to, these Terms or the website, products, or services shall be instituted exclusively in the federal courts of the United States or the courts of the State of Texas, in each case located in the City of Weatherford and County of Parker. You waive any and all objections to the exercise of jurisdiction over you by such courts and to venue in such courts.
